Interpretation
The words of which the initial letter is capitalized have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or in plural.

For the purposes of this Privacy Policy:
- Account means a unique account created for You to access Our Service or parts of Our Service.
- Company (referred to as either “the Company”, “We”, “Us” or “Our” in this Agreement) refers to ImEX Systems Inc., 3446 Galloway Ave, Coquitlam, British Columbia, Canada.
- Cookies are small files that are placed on Your computer, mobile device or any other device by a website, containing the details of Your browsing history on that website among its many uses.
- Controller means a person that, alone or jointly with others, determines the purposes for and means of processing Personal Data.

- Personal Data is any information that relates to an identified or identifiable natural person.
- Process, Processes, or Processing means the collection, use, sale, storage, disclosure, analysis, deletion, or modification of Personal Data and includes the actions of a Controller directing a Processor to Process Personal Data.
- Processor shall have the same meaning as “Service Provider” as used in this Privacy Policy.
- Sale, Sell or Sold means selling, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s personal information by the business to a third party for monetary or other valuable consideration.
- Share means sharing, renting, releasing, disclosing, disseminating, making available, transferring, or otherwise communicating orally, in writing, or by electronic or other means, a consumer’s Personal Data by the business to a third party for cross-context behavioral advertising or targeted marketing, whether or not for monetary or other valuable consideration.
- Service refers to the Website and any activities which Company engages in with You offline, such as when you interact with us at a trade event.
- Service Provider means any natural or legal person who Processes data on behalf of the Company. It refers to third-party companies or individuals employed by the Company to facilitate the Service, to provide the Service on behalf of the Company, to perform services related to the Service or to assist the Company in analyzing how the Service is used.
- Usage Data refers to data collected automatically, either generated by the use of the Service or from the Service infrastructure itself (for example, the duration of a page visit).
- Website refers to ImEX Systems Inc., accessible from imexsystems.ca
- You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service, as applicable.
What does this Privacy Policy Cover?
Some data protection laws distinguish between the activities that a business conducts on behalf of another business or person (sometimes referred to as a “Processor,” “Third Party” or “Service Provider”), and those activities that a business conducts on behalf of itself (sometimes referred to as a “Controller” or “Business”). This Privacy Policy covers only those activities that Company conducts as a Controller of Your Personal Data, including when You visit or engage with Our website, when You engage with Us through marketing campaigns, and when You use Our Services. It does not cover those activities where Company acts as a Processor to its customers.
We operate as a Software-as-a-Service (“SaaS”) business model, which means that We may Process the Personal Data of Our customer’s data subjects on Our Service. Where We Process Personal Data as a Processor, We do so only in accordance with Our customer’s instructions and this Privacy Policy does not apply. Where Company acts as a Processor for the Personal Data of Our customer’s data subjects, the privacy policy of Our customer applies.

How We Collect Your Personal Data

- Directly from You when You use Our Services;
- Other direct interactions with You, for example when You correspond with Us by phone, email or otherwise;

- Automated technologies or interactions, as You use Our Services. Information collected automatically may include Usage Data collected through tracking technologies and cookies outlined below.
Types of Data Collected
While using Our Service, We may collect, use or disclose the following types of Your Personal Data:

Usage Data Collected Automatically
Usage Data is collected automatically when using the Service.
Usage Data may include information such as Your Device’s Internet Protocol address (e.g. IP address), browser type, browser version, the pages of Our Service that You visit, the time and date of Your visit, the time spent on those pages, unique device identifiers and other diagnostic data.
When You access the Service by or through a mobile device, We may collect certain information automatically, including, but not limited to, the type of mobile device You use, Your mobile device unique ID, the IP address of Your mobile device, Your mobile operating system, the type of mobile Internet browser You use, unique device identifiers and other diagnostic data.
We may also collect information that Your browser sends whenever You visit Our Service or when You access the Service by or through a mobile device.

- Third Party Analytics. We may use third parties’ analytics and tracking tools to better understand who is using the Services, how people are using the Services, how to improve the effectiveness of the Services and related content, and to help Us or those third parties serve more targeted advertising to You across the Internet. We use automated devices and applications, such as Google Analytics, to evaluate usage of Our Site. Analytics providers collect information such as how often users visit Our Site, what pages they visit when they do, and what other sites they visit prior to visiting Our Site. Company does not allow for third parties to place cookies or other tracking technologies on Our Service that would collect Your Personal Data about Your online activities over time and across different websites.

Do Not Track Signals. Some web browsers allow You to turn on Do Not Track (“DNT”), which sends signals to websites You visit, telling those sites that You do not want Your online activities to be tracked. Our Services currently are not designed to respond to DNT signals received from web browsers.
Personal Data Provided by Others
Where permitted by law, We may also receive Your Personal Data from third parties in order to connect with You regarding our products and services, such as through trade associations to which You and Company belong. When We receive information about You for direct marketing, We may collect the following information from third parties:
- Contact information, such as Your name, job title, company You work for, business contact details (including email, company headquarters, office address, and phone number), education, and any other information available through public directories.
Where You no longer wish to receive direct marketing communications from Company, You may unsubscribe through the email which You received or make a request via the Contact Us section of this Privacy Policy.
Use of Your Personal Data
The Company may use Personal Data for the following purposes:
- To provide and maintain Our Service, including to monitor the usage of Our Service, to maintain the security and integrity of our Service, and for fraud detection.
- To manage Your Account: to manage Your registration as a user of the Service. The Personal Data You provide can give You access to different functionalities of the Service that are available to You as a registered user.

We may disclose Your Personal Data in the following situations:
- With Service Providers: We may disclose Your Personal Data with Service Providers to monitor and analyze the use of Our Service, to contact You.
- For business transfers: We may disclose or transfer Your Personal Data in connection with, or during negotiations of, any merger, sale of Company assets, financing, or acquisition of all or a portion of Our business to another company.
- With Affiliates: We may disclose Your information with Our affiliates to meet Our legal and compliance requirements and operational needs, in which case We will require those affiliates to honor this Privacy Policy. Affiliates include Our parent company and any other subsidiaries, joint venture partners or other companies that We control or that are under common control with Us.
- With business partners: We may disclose Your information with Our business partners to offer You certain products, services or promotions.
- With other users: when You disclose Personal Data or otherwise interact in the public areas with other users, such information may be viewed by all users and may be publicly distributed outside.
- With Your consent: We may disclose Your Personal Data for any other purpose with Your consent.
In circumstances where We disclose Your Personal Data with third parties such as Service Providers and Our affiliates and business partners, these third parties are contractually obligated to keep Personal Data confidential and use it only for the purposes for which we disclose it to them.
Retention of Your Personal Data
The Company will retain Your Personal Data only for as long as is necessary for the purposes set out in this Privacy Policy. We will retain and use Your Personal Data to the extent necessary to comply with Our legal obligations (for example, if We are required to retain Your data to comply with applicable laws), resolve disputes, and enforce Our legal agreements and policies.
The Company will also retain Usage Data for internal analysis purposes. Usage Data is generally retained for a shorter period of time, except when this data is used to strengthen the security or to improve the functionality of Our Service, or We are legally obligated to retain this data for longer time periods.
Transfer of Your Personal Data
Your information, including Personal Data, is processed at the Company’s operating offices and in any other places where the parties involved in the Processing are located. It means that this information may be transferred to — and maintained on — computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from Your jurisdiction.
Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.
The Company will take all steps reasonably necessary to ensure that Your data is treated securely and in accordance with this Privacy Policy and no transfer of Your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of Your data and other Personal Data.

Disclosure of Your Personal Data
Business Transactions
If the Company is involved in a merger, acquisition or asset sale, Your Personal Data may be transferred. We will provide notice before Your Personal Data is transferred and becomes subject to a different Privacy Policy.
Law enforcement
Under certain circumstances, the Company may be required to disclose Your Personal Data if required to do so by law or in response to valid requests by public authorities (e.g. a court or a government agency).

Fulfill Transactions
In order to fulfill a transaction We disclose Your billing information with third parties to process credit card payments on Our behalf.

The security of Your Personal Data is important to Us, but remember that no method of transmission over the Internet, or method of electronic storage is 100% secure. While We strive to use commercially acceptable means to protect Your Personal Data, We cannot guarantee its absolute security.
Children’s Privacy
Our Service does not address anyone under the age of 13. We do not knowingly collect personally identifiable information from anyone under the age of 13. If You are a parent or guardian and You are aware that Your child has provided Us with Personal Data, please contact Us. If We become aware that We have collected Personal Data from anyone under the age of 13 without verification of parental consent, We take steps to remove that information from Our servers.
If We need to rely on consent as a legal basis for Processing Your information and Your country requires consent from a parent, We may require Your parent’s consent before We collect and use that information.

Canadian Data Subject Rights
You have the right to request access to or correction of Personal Data in Our control and to withdraw Your consent to Our collection, use or disclosure of Your Personal Data. Depending on the circumstances, however, withdrawal of Your consent may impact Our ability to serve You.
You may access or correct Your Personal Data or withdraw Your consent by contacting Us using information outlined in the ‘Contact Us’ section below. These rights are subject to applicable legal and contractual restrictions, and We will respond to Your request consistent with applicable law. Please note that We may take appropriate steps to verify Your identity before responding to Your request.
U.S. Data Subjects
Legal Categories of “Personal Information”
Certain laws require us to tell You about the Personal Data We collect about You in a certain way – specifically, We need to link it to “legal categories” of Personal Data that are listed in the law. To do this, We bundled up the information We gave You above in this Privacy Policy and matched the different types of Personal Data We collect about You with the legal category.
To make things easier to understand, We have put this information in the Privacy Chart that describes the sources, purposes, relevant disclosures for a business purpose and whether We Sell or Share Personal Data by legal category. The Privacy Chart is found in Annex I of this Privacy Policy.
Data Subject Rights
Some U.S. privacy laws require that We disclose the privacy rights that You may have regarding Your Personal Data. We have defined the various rights below. To see which rights apply to You, refer to the Privacy Rights Chart immediately following this subsection.
For all Personal Data that We collect about You, You may have the following rights or choices that We will accommodate where Your requests meet legal and regulatory requirements and do not risk making Our other data less secure or changing Our other data. You may also designate an authorized agent to make a request on Your behalf.
Access:
You may have the right to know the categories of Personal Data collected about you, the legal basis for Processing Your Personal Data, and to know whether Your Personal Data is disclosed / Sold and to whom. You also may have the right to access Your Personal Data and to receive a copy of Your information.
Data Portability:
You may have the right to request the transfer of Your Personal Data to You or to a third party. We will provide to you, or a third party You have chosen, Your Personal Data in a structured, commonly used, machine-readable format. Note that this right only applies to automated information which You initially provided consent for Us to use or where We used the information to perform a contract with you.
Deletion:
You also may request that We erase Your information. You also have the right to ask Us to delete or remove Your Personal Data where You have successfully exercised Your right to object to Processing (see below), where We may have processed Your information unlawfully or where We are required to erase Your Personal Data to comply with local law. Note, however, that We may not always be able to comply with Your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of Your request.
Control Sensitive Personal Data:
You may have the right in certain circumstances to control the processing of Your Sensitive Personal Data, including consenting to the collection, or limiting the use or disclosure to that use which is necessary to perform the services and which is reasonably expected by the average consumer requesting the services. For the avoidance of doubt, “Sensitive Personal Data” as used in this Privacy Policy shall have the same meaning as “sensitive personal information” and “sensitive data” under applicable data protection laws.
Non-Discrimination / Non-Retaliation:
You may have the right not to receive discriminatory treatment by the Company because You exercise Your privacy rights.
Opt out of the Sale or Sharing:
You may have the right to opt out of the Sale of Your Personal Data, to the extent applicable. Company does not engage in the Sale of Personal Data. You may also have the right to request that We do not Share Your Personal Data with third parties.
Opt out of Profiling and/or Targeted Advertising:
You may have the right to opt out of the Processing of Your Personal Data for the purposes of Targeted Advertising, Cross Context Behavioral Advertising, or Profiling which is used in furtherance of decisions that produce legal or similarly significant effects. “Profiling” means any automated processing of Personal Data to evaluate, analyze, or predict aspects concerning an individual’s economic situation, health, personal preferences, interest, reliability, behavior, location or movements.
The Right to Appeal:
You may have the right to appeal a decision We make whether or not to take action on any request to exercise one of your privacy rights.
Request Correction:
You may have the right to request correction of the Personal Data that We hold about you. This enables You to have any incomplete or inaccurate data We hold about You corrected, though We may need to verify the accuracy of the new data You provide to Us.

How to make a Request and What to Expect
How to Make a Request
If You would like to make a request, please use the email provided in the Contact Us section at the bottom of this page. Please provide Your full name, phone number and email address, as well as a description of the right(s) You are seeking to exercise.
Responding to Requests
Your request will be evaluated to determine whether it meets the legal requirements and whether We have a legal obligation that prohibits Us from fulfilling Your request. After We evaluate Your request, We will respond to update You on the status of Your request.
If We are unable to honor any part of Your request, such as if a request would make other data less secure, or where We have a legal obligation that prohibits Us from being able to honor Your request, We will tell You that in Our response, as well as the reason(s) We cannot do so.
Verifying Your Identity
To protect You and Your information, We may ask You to confirm certain information before We honor Your request. For example, if You make a request, We will ask You to confirm information that can link You uniquely to Our records, including Your name, email address, and/or phone number to verify Your identity, so that We can help protect Your information. If You designate an authorized agent to make a request on Your behalf, We may require You to verify Your identity and provide the authorized agent’s identity and contact information to Us.
Only You, or an representative that You authorize to act on Your behalf, may make a verifiable consumer request related to Your Personal Data.
The verifiable consumer request must:
- Provide sufficient information that allows Us to reasonably verify You are the person about whom We collected Personal Data or an authorized representative.
- Describe Your request with sufficient detail that allows Us to properly understand, evaluate, and respond to it.
We cannot respond to Your request or provide You with Personal Data if We cannot verify Your identity or authority to make the request and confirm the Personal Data relates to You. We will only use Personal Data provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Our Service may contain links to other websites that are not operated by Us. If You click on a third party link, You will be directed to that third party’s site. We strongly advise You to review the Privacy Policy of every site You visit.
We have no control over and assume no responsibility for the content, privacy policies or practices of any third party sites or services.
Changes to this Privacy Policy
We may update Our Privacy Policy from time to time. We will notify You of any changes by posting the new Privacy Policy on this page.
We will let You know via email and/or a prominent notice on Our Service, prior to the change becoming effective and update the “Last updated” date at the top of this Privacy Policy.
